Confirming a decision from the Geneva Cantonal Court the Swiss Federal Court considers that bank employees have the right to access a copy of the documents sent to US authorities, including the US Department of Justice (DoJ).

Obtaining a copy will allow the concerned persons to check the data transmitted and have the possibility of comparing the documents at issue with other information that may be in their possession, and decide on further course of action.

As reported by the newspaper 20 Minutes, D. Hornung, the defending lawyer, estimates that at least 40,000 persons or entities could be affected by this verdict. The lawyer stresses that all those who have asked for interim measures prohibiting a bank to send their data received a favorable decision of the cantonal courts in Geneva, Vaud, and Zurich.
